Critical, long-overdue BlackBerry makeover arrives






TORONTO (AP) — BlackBerry maker Research In Motion Ltd. will kick off a critical, long-overdue makeover when chief executive Thorsten Heins shows off the first phone with the new BlackBerry 10 system in New York on Wednesday.


Repeated delays have left the once-pioneering BlackBerry an afterthought in the shadow of Apple’s trend-setting iPhone and Google’s Android-driven devices. There has even been talk that the fate of the company that created the BlackBerry in 1999 is no longer certain.






Now, there’s some optimism. Previews of the BlackBerry 10 software have gotten favorable reviews on blogs. Financial analysts are starting to see some slight room for a comeback. RIM‘s stock has more than doubled to $ 15.66 from a nine-year low in September, though it’s still nearly 90 percent below its 2008 peak of $ 147.


RIM redesigned the system to embrace the multimedia, apps and touch-screen experience prevalent today. The company is promising a speedier device, a superb typing experience and the ability to keep work and personal identities separate on the same phone.


Most analysts consider a BlackBerry 10 success to be crucial for the company’s long-term viability. Doubts remain about the ability of BlackBerry 10 to rescue RIM.


“We’ll see if they can reclaim their glory. My sense is that it will be a phone that everyone says good things about but not as many people buy,” BGC Financial analyst Colin Gillis said.


Jefferies analyst Peter Misek called it a “great device” and said RIM does have some momentum just months after the Canadian company was written off for dead.


“Six months ago we talked to developers and carriers, and everybody was just basically saying ‘We’re just waiting for this to go bust,’” Misek said. “It was bad.”


The BlackBerry has been the dominant smartphone for on-the-go business people and crossed over to consumers. But when the iPhone came out in 2007, it showed that phones can do much more than email and phone calls. Suddenly, the BlackBerry looked ancient. In the U.S., according to research firm IDC, shipments of BlackBerry phones plummeted from 46 percent of the market in 2008 to 2 percent in 2012.


RIM promised a new system to catch up, using technology it got through its 2010 purchase of QNX Software Systems. RIM initially said BlackBerry 10 would come by early 2012, but then the company changed that to late 2012. A few months later, that date was pushed further, to early 2013, missing the lucrative holiday season. The holdup helped wipe out more than $ 70 billion in shareholder wealth and 5,000 jobs.


Although executives have been providing a glimpse at some of BlackBerry 10′s new features for months, Heins will finally showcase a complete system at Wednesday’s event. Devices will go on sale soon after that. The exact date and prices are expected Wednesday.


Regardless of BlackBerry 10′s advances, though, the new system will face a key shortcoming: It won’t have as many apps written by outside companies and individuals as the iPhone and Android. RIM has said it plans to launch BlackBerry 10 with more than 70,000 apps, including those developed for RIM’s PlayBook tablet, first released in 2011. Even so, that’s just a tenth of what the iPhone and Android offer. Popular service such as Instagram and Netflix won’t have apps on BlackBerry 10.


Gillis said he’ll be looking to see when RIM releases a keyboard version of the new phone. The first BlackBerry 10 phone will have only a touch screen. RIM has said a physical keyboard version will be released soon after. He said a delay could alienate RIM’s 79 million subscribers.


“The No. 1 feature that they like is the physical keyboard,” Gillis said.

A-Rod implicated in PED use again as MLB probes


NEW YORK (AP) — Alex Rodriguez is in the middle of Major League Baseball's latest doping investigation after an alternative weekly newspaper reported baseball's highest-paid star was among the big leaguers listed in the records of a Florida clinic the paper said sold performance-enhancing drugs.


The Miami New Times said Tuesday that the three-time AL MVP bought human growth hormone and other performance-enhancing substances during 2009-12 from Biogenesis of America LLC, a now-closed anti-aging clinic in Coral Cables, Fla., near Rodriguez's offseason home.


The new public relations firm for the New York Yankees third baseman issued a statement denying the allegations.


New Times said it obtained records detailing purchases by Rodriguez, 2012 All-Star game MVP Melky Cabrera, 2005 AL Cy Young Award winner Bartolo Colon and 2011 AL championship series MVP Nelson Cruz of Texas.


Cabrera left San Francisco after the season to sign with Toronto, while Oakland re-signed Colon.


Other baseball players the newspaper said appeared in the records include Washington pitcher Gio Gonzalez, who finished third in last year's NL Cy Young Award voting, and San Diego catcher Yasmani Grandal.


Biogenesis, which the New Times said was run by Anthony Bosch, was located in a beige, nondescript office park. The former clinic is no longer listed as a business in its directory,


"There was a flier put out by the building management a couple weeks ago. It was put on all the doors and windows of all the offices," said Brad Nickel, who works in a cruise planning company on the floor above where the clinic was located. "It just said this guy's not really a doctor, he doesn't belong here, he's no longer allowed here, call the police or the building management if you see him."


The New Times posted copies of what it said were Bosch's handwritten records, obtained through a former Biogenesis employee it did not identify.


Bosch's lawyer, Susy Ribero-Ayala, said in a statement the New Times report "is filled with inaccuracies, innuendo and misstatements of fact."


"Mr. Bosch vehemently denies the assertions that MLB players such as Alex Rodriguez and Gio Gonzalez were treated by or associated with him," she said.


Rodriguez appears 16 times in the documents New Times received, the paper said, either as "Alex Rodriguez," ''Alex Rod" or the nickname "Cacique," a pre-Columbian Caribbean chief.


Rodriguez admitted four years ago that he used PEDs from 2001-03. Cabrera, Colon and Grandal were suspended for 50 games each last year by MLB following tests for elevated testosterone. Responding to the testosterone use, MLB and the players' union said Jan. 10 they were authorizing the World Anti-Doping Agency laboratory outside Montreal to store each major leaguer's baseline testosterone/epitestosterone (T/E) ratio in order to detect abnormalities.


"We are always extremely disappointed to learn of potential links between players and the use of performance-enhancing substances," MLB said in a statement. "Only law enforcement officials have the capacity to reach those outside the game who are involved in the distribution of illegal performance-enhancing drugs. ... We are in the midst of an active investigation and are gathering and reviewing information."


A baseball official, speaking on condition of anonymity because he was not authorized to make public statements, said Monday that MLB did not have any documentation regarding the allegations. If MLB does obtain evidence, the players could be subject to discipline. First offenses result in a 50-game suspension and second infractions in 100-game penalties. A third violation results in a lifetime ban.


Rodriguez is sidelined for at least the first half of the season after hip surgery Jan. 16. A 50-game suspension would cost him $7.65 million of his $28 million salary.


"The news report about a purported relationship between Alex Rodriguez and Anthony Bosch are not true," Rodriguez said in a statement issued by a publicist. "He was not Mr. Bosch's patient, he was never treated by him and he was never advised by him. The purported documents referenced in the story — at least as they relate to Alex Rodriguez — are not legitimate."


Jay Reisinger, a lawyer who has represented Rodriguez in recent years, said the three-time AL MVP had retained Roy Black, an attorney from Rodriguez's hometown of Miami. Black's clients have included Rush Limbaugh and William Kennedy Smith.


Bosch did not return a phone message seeking comment.


MLB hopes to gain the cooperation of Bosch and others connected with the clinic, another baseball official said, also on condition of anonymity because no public statements on the matter were authorized. In order to successfully discipline players based on the records, witnesses would be needed to authenticate them, the official said.


Players could be asked to appear before MLB for interviews, but the official said MLB would be reluctant to request interviews before it has more evidence.


Rodriguez spent years denying he used PEDs before Sports Illustrated reported in February 2009 that he tested positive for two steroids in MLB's anonymous survey while with the Texas Rangers in 2003. Two days later, he admitted in an ESPN interview that he used PEDs over a three-year period. He has denied using PEDs after 2003.


If the new allegations were true, the Yankees would face high hurdles to get out of the final five years and $114 million of Rodriguez's record $275 million, 10-year contract. Because management and the players' union have a joint drug agreement, an arbitrator could determine that any action taken by the team amounted to multiple punishments for the same offense.


But if Rodriguez were to end his career because of the injury, about 85 percent of the money owed by the Yankees would be covered by insurance, one of the baseball officials said.


Gonzalez, 21-8 for the Washington Nationals last season, posted on his Twitter feed: "I've never used performance enhancing drugs of any kind and I never will, I've never met or spoken with tony Bosch or used any substance provided by him. anything said to the contrary is a lie."


Colon was not issuing a statement, agent Adam Katz said through spokeswoman Lisa Cohen.


"We are aware of certain allegations and inferences," Cruz's law firm, Farrell & Reisinger, said in a statement. "To the extent these allegations and inferences refer to Nelson, they are denied."


Cruz and Gonzalez had not previously been linked to performance-enhancing drugs. Cruz hit 24 home runs last year for the Rangers.


The New Times report said it obtained notes by Bosch listing the players' names and the substances they received. Several unidentified employees and clients confirmed to the publication that the clinic distributed the substances, the paper said. The employees said that Bosch bragged of supplying drugs to professional athletes but that they never saw the sports stars in the office.


The paper said the records list that Rodriguez paid for HGH; testosterone cream; IGF-1, a substance banned by baseball that stimulates insulin production; and GHRP, which releases growth hormones.

BlackBerry 10’s Debut Is a Critical Day for Research in Motion





OTTAWA — Research in Motion’s introduction on Wednesday of a new BlackBerry phone will be the most important event in the company’s history since 1996, when its founders showed investors a small block of wood and promised that a wireless e-mail device shaped like that would change business forever.




Now with just 4.6 percent of the global market for smartphones in 2012, according to IDC, RIM long ago exchanged dominance for survival mode. On Wednesday, the company will introduce a new line of smartphones called the BlackBerry 10 and an operating system of the same name that Thorsten Heins, the president and chief executive of RIM, says will restore the company to glory.


But Frank Mersch, who became one of RIM’s earliest investors after seeing the block of wood, is far less excited by what he sees this time around.


“You’re in a very, very competitive market and you’re not the leader,” Mr. Mersch, now the chairman and a vice president at Front Street Capital in Toronto, said of RIM. “You have to ask: ‘At the end of the day are we really going to win?’ I personally think the jury’s out on that.”


The main elements of the new phones and their operating system are already well known. Mr. Heins and other executives at RIM have been demonstrating the units for months to a variety of audiences. App developers received prototype versions as far back as last spring.


While analysts and app developers may be divided about the future of RIM, there is a consensus that BlackBerry 10, which arrives more than year behind schedule, was worth the wait.


Initially RIM will release two variations of the BlackBerry 10, one a touch-screen model that resembles many other phones now on the market. The other model is a hybrid with a keyboard similar to those now found on current BlackBerrys as well as a small touch screen.


The real revolution, though, may be in the software that manages a person’s business and personal information. It is clearly designed with an eye toward retaining and, more important, luring back, corporate users.


Corporate and government information technology managers will be able to segregate business-related apps and data on BlackBerry 10 handsets from users’ personal material through a system known as BlackBerry Balance. It will enable an I.T. manager to, among other things, remotely wipe corporate data from fired employees’ phones while leaving the newly jobless workers’ personal photos, e-mails, music and apps untouched. The system can also block users from forwarding or copying information from the work side of the phone.


Messages generated by e-mail, Twitter, Facebook, instant messaging and LinkedIn accounts are automatically consolidated into a single in-box that RIM calls BlackBerry Hub.


Charles Golvin, an analyst with Forrester Research, called the new phones “beautiful” and described the operating system as “a giant leap forward” from RIM’s current operating system. Ray Sharma, who followed RIM’s glory years as a financial analyst but who now runs XMG Studio, a mobile games developer in Toronto, has been similarly impressed.


But both men are among many analysts who question the ability of BlackBerry 10, whatever its merits, to revive RIM’s fallen fortunes.


“If it’s good, it will help inspire the upgrade cycle,” Mr. Sharma said. “But it has to be great in order to inspire touch-screen users to come back. If it’s good, not great, I will be concerned.”


Mr. Golvin was more blunt. “They’ll need to prove themselves in the face of a simultaneous onslaught of marketing from Microsoft, not to mention the continued push from Apple plus Google and its Android partners,” he wrote. “This is a gargantuan challenge for a company of RIM’s size.”


In the year since he took over from the founders, Jim Balsillie and Mike Lazaridis, Mr. Heins has certainly remade RIM. He cut 5,000 jobs in a program to reduce operating costs by about $1 billion a year. Along the way, he also replaced RIM’s senior management and straightened out its balance sheet. While unprofitable, RIM remains debt-free and holds $2.9 billion in cash.


With BlackBerry 10, RIM not only started over with its operating system, it also rebuilt the company through acquisitions. Its core operating system comes from QNX Software Systems, the design of the user interface is largely the work of the Astonishing Tribe in Sweden while other main components, like the touch-screen technology, came from smaller companies that are now part of RIM.


Integrating all of those acquisitions, analysts and former RIM employees say, added to the delays that plagued BlackBerry 10.


Now that the new phones are finally here, Mr. Heins is counting on RIM’s remaining base of 79 million users globally to eagerly upgrade. But where those customers reside may be as important in their numbers in determining the success of that plan.


In the United States, which leads the world in setting smartphone trends, about 11 million BlackBerry users switched to other phones between 2009 and the middle of last year, according to an analysis by Horace Dediu on Asymco, a wireless industry blog he founded.


Until the final months of 2012, RIM continued to increase its subscriber base through sales of low-cost handsets to less developed countries like Nigeria and Indonesia. Although BlackBerry 10 will be made available worldwide, the initial phones will be too expensive for a majority of BlackBerry fans in those regions.


RIM may also have confused its loyalists, particularly in North America and Europe, in the run-up to the BlackBerry 10 debut. Many of those users stuck with BlackBerrys because of their physical keyboards. But public demonstrations for BlackBerry 10 were centered on the touch-screen-only version and its virtual keyboard.


While some corporations have remained loyal to BlackBerry, RIM not only has to sell them on the new handsets, it also must persuade them to upgrade server software to accommodate the new operating system, a costly and time-consuming process. Companies whose employees continue to use older BlackBerrys will have to run two separate BlackBerry servers.


Mr. Heins’s pitch to those corporations is that the BlackBerry 10 server software will also allow them to manage and control data on employees’ Android phones and iPhones. But any corporation or organization that allows those phones to connect with its systems long ago installed mobile device management software from other companies, including Good Technology and SAP. RIM is likely to find that the competition in device management software is as severe as it is in the handset business.

IHT Rendezvous: Regulating the British Press

LONDON — News doesn’t just travel fast here. It happens fast, too. And once it has happened, new news overtakes the old: the dogs bark, as the old Middle Eastern adage has it, but the caravan moves on.

So it has seemed in the almost two months since the publication of the bulky Leveson Report into the culture and behavior of the British press. The land has been swamped by a procession of other front-page stories — British hostages in Algeria! Referendum on Europe! — and the urgency of Lord Justice Sir Brian Leveson’s call for statutory oversight of the rambunctious press here seems to have dissipated.

But a couple of developments in recent days have recalled some of the issues — quite apart from a steady trickle of arrests linked to the phone hacking and allied scandals that prompted the Leveson inquiry in the first place.

One was the return from duty in Afghanistan of Prince Harry, the third in line to the British throne, who, as I describe in my latest column on Page Two of The International Herald Tribune, stirred a media frenzy by acknowledging that — no real surprise here — as the gunner co-pilot of an Apache attack helicopter, he was expected to fire on Taliban insurgents.

But there was a sub-plot.

Prince Harry’s aversion to the British media — equally unsurprising in light of the tangled relationship between his mother, Princess Diana, and the world’s newspapers, photographers and broadcasters — appears to be growing to the extent that he accused the British press of always writing “rubbish” about him.

And yet, for the 20 weeks of Prince Harry’s deployment in Afghanistan, most news outlets in Britain had largely agreed with Buckingham Palace and the Ministry of Defense not to cover closely his role in the war, in return for guaranteed access at the end of his tour — a gesture of what the authorities would doubtless call responsibility on the part of that same press the prince dismissed.

The prince’s comments drew a tart response from Peter Barron, the editor of the regional Northern Echo. “It would have been nice if Prince Harry had resisted getting out his huge tar brush to blacken the entire British press and acknowledged that there are good and bad in every profession — including the armed forces,” he said.

The broader issue of how Britain regulates its media is still the object of closed-door talks among editors and executives and between politicians. But it could well resurface publicly next month.

“This is not about politicians determining what journalists do or do not write. The freedom of the press is essential,” Harriet Harman, the spokeswoman on media affairs for the opposition Labour Party, told a gathering in Oxford, England, last week. “But so is that other freedom: the freedom of a private citizen to go about their business without harassment, intrusion or the gross invasion of their grief and trauma. Those two freedoms are not incompatible.”

She challenged the government directly to set out its own proposals for the future regulation of the press.

“It is now time for the government to have the courage of its convictions,” she said, adding: “The public must be able to scrutinize the proposals. And Parliament — to whom Lord Justice Leveson trusted a key role in setting up the new system — must be able to decide.”

Cómo se desarrolló el Linux de las netbooks educativas






La elección de un sistema operativo para una computadora es una situación que, en situaciones cotidianas al ingresar a una tienda de venta de artículos electrónicos, está marcada por la presencia de la plataforma Windows de Microsoft. Nada de esto impide que los usuarios puedan optar por software libre, sin costo alguno al momento de realizar la descarga e instalación, con propuestas como Ubuntu, Fedora o Mint , por mencionar sólo algunas de las alternativas disponibles en Internet.


Esto mismo ocurrió con el plan Conectar Igualdad, que busca desarrollar su propia plataforma basada en GNU-Linux adaptada a las necesidades de la comunidad educativa, tanto para los docentes como para los alumnos.






La inciativa comenzó a tomar forma en 2010, cuando Javier Castrillo comenzó a trabajar en Conectar Igualdad, el programa del gobierno nacional que distribuye computadoras portátiles para alumnos y docentes de escuelas públicas. Desde aquel momento, con el antecedente de haber coordinado la implementación de estas iniciativas en el ambiente educativo, impulsó con su equipo el desarrollo de Huayra, el sistema operativo libre basado en GNU-Linux de las netbooks escolares.


“Debido al porte de este programa era necesaria una plataforma estable, libre, un estándar y sobre todo con soberanía tecnológica, para no depender de ninguna corporación. Con nuestro sistema nos aseguramos que va a ser constante en el tiempo, que va a ser gratuito para todos aquellos que lo quieran descargar y, por sobre todas las cosas, libre. Todo el código está publicado a disposición para que cualquiera que tenga los conocimientos lo pueda auditar y modificar”, asegura Javier Castrillo, coordinador del Proyecto Huayra.


En una entrevista exclusiva con LA NACIÓN , Javier Castrillo habla sobre la plataforma, sus características y los prejuicios que aún existen sobre el software libre.


¿Qué es Huayra?


Es el sistema operativo libre que las netbooks del Programa Conectar Igualdad van a traer instaladas a partir de este año. Además cualquier persona puede descargarlo en su máquina desde huayra.conectarigualdad.gob.ar


Está basado en Debian GNU/Linux, es seguro, ágil y con un desarrollo realizado en la Argentina, teniendo en cuenta las necesidades tanto de estudiantes como de docentes, y manteniendo nuestra identidad nacional.


¿En qué instancia se encuentra el desarrollo?


Está en fase Beta pero ya se puede bajar y utilizar.


Un mito presente en este tipo de plataformas es que muchas personas creen que no hay virus porque no se conoce mucho. Esto no es verdad, no hay virus porque el sistema no admite virus porque, como dije, está todo a la vista. Los servidores de la bases de datos de los bancos, las grandes bases de datos importantes son de código libre, Google es libre, por ejemplo.


¿Por qué pensaron que era necesario desarrollar un sistema operativo basado en software libre?


Porque se estaban dejando tres millones y medio de máquinas en manos de una corporación, que tiene intereses económicos y sus tiempos. Asimismo, por ejemplo, si queríamos hacer un procesador de texto para las comunidades aborígenes no podíamos hacerlo porque no es posible traducir el Word o si necesitábamos adaptar la placa de red, según el tipo de servicio de determinada zona también teníamos inconvenientes. Tener un software de una empresa es como comprarte un auto y tener el capó soldado.


¿Cuáles son las ventajas que presenta utilizar Huayra frente a Windows?


Es libre y puede ser utilizado por cualquier persona de la comunidad; es gratuito, y ofrece la libertad de poder administrar ese código y hacer las reformas que queremos. Uno de los problemas que veíamos era que los profesores traían un programa para compartir con los chicos y ponían el pendrive en cada computadora y lo bajaban, sin darse cuenta que podían utilizar la red de la escuela. Lo que sucede es que configurar una red no es algo trivial. Huayra, en cambio, autoconfigura la red entonces el profesor deja el programa directamente en una carpeta especial que comparte y los alumnos entran allí para utilizar el programa.


¿En qué se benefician los alumnos al utilizar Huayra?


Que el Estado les brinde su propio sistema operativo libre es un beneficio implícito es más seguro y mucho más rápido. Además, está pensado para que corra en las máquinas más livianas y también funciona bien en las máquinas más viejas.


Otra gran ventaja para los chicos es que tienen una herramienta que sale de la propia escuela, con las necesidades y el aporte de su institución. Hay cientos de aplicaciones del equipo de Huayra y aportadas por las comunidades escolares. En total son casi 30.000 piezas de software.


¿La interfaz es similar a la de Windows o los usuarios verán muchos cambios?


Es similar y además encontrarán programas que no tenían en Windows porque son muy caros. En Huayra, por ejemplo, hay un software para hacer animaciones en 3D que si tuviéramos que comprarlo saldría muy caro. También hay editores de fotos similares a Photoshop.


El procesador de textos de Huayra permite guardarlo en un formato de Word. En el pasado había grandes problemas de compatibilidad entre el software libre y el licenciado pero ahora todo ha evolucionado y ya no existen esos inconvenientes.


Las netbooks de Conectar Igualdad son de diez fabricantes distintos, y tuvimos que trabajar bastante para el desarrollo del sistema operativo, cuenta Javier Castrillo, responsable del proyecto Huayra


Todavía nos falta un buen programa de Autocad 3D, pero tenemos Autocad en 2D. Pero tenemos son muchas herramientas de programación y de robótica incluidas dentro de Hayra.


¿Cómo se realizará la capacitación?


Las netbooks de nuestro programa, a partir de 2012, incluyen TV Digital abierta y allí incluye un montón de tutoriales y paso a paso para poder aprender a utilizarla.


Por otro lado, todas las instancias de capacitación que tiene Educar y el Ministerio de Educación van a tener cursos de Huayra tanto para alumnos como para docentes. Y ya se han formado comunidades de Huayra en Facebook y en Twitter que hacen su propia formación y su aporte a la comunidad.


¿Qué obstáculos tuvieron que sortear?


La principal fue la compatibilidad de hardware. Las netbooks de Conectar Igualdad son de diez fabricantes distintos y tuvimos que trabajar bastante para hacer funcionar nuestro sistema en todos los equipos. Después debimos luchar con los prejuicios que difunden los propios monopolios, que dicen que Linux es difícil, por ejemplo.


Pero ahora estamos muy entusiasmados porque las pruebas están saliendo bien y estamos dentro de los tiempos previstos.


¿Cuáles son los principales proyectos?


La primera etapa de Huayra es que funcione bien en todas las netbooks y en eso estamos abocados. Luego estamos pensando en que funcione en tablets y celulares.


También queremos trabajar para que la TV digital no sirva sólo para ver canales sino que podamos interactuar y brindarle, a través de ella, información útil para el ciudadano.


Y queremos fomentar el desarrollo para que los chicos programen, dándoles herramientas para que puedan programar aunque no sepan hacerlo, para que puedan, por ejemplo, hacer sus propios juegos con las características de su región, de su lenguaje, sus costumbres y que lo compartan con la comunidad.

Linux eligió el pingüino, nosotros una vaca”, explica Javier Castrillo.


El equipo de trabajo de Huayra consta de 13 personas, divididos en tres áreas: Desarrollo (programadores), Diseño (artistas, historiadores del arte, diseñadores gráficos) y Sistematización (Sociólogos y estadísticos).


Además de Huayra existe la iniciativa de la comunidad de software libre Tuquito, con sendas versiones para las computadoras de las iniciativas OLPC y Conectar Igualdad .

Woods makes short work at Torrey Pines


SAN DIEGO (AP) — Tiger Woods never looked so irritated winning a golf tournament so comfortably.


His record eighth victory at Torrey Pines was all but over when Woods ripped a 5-iron from 244 yards over the corner of a bunker and onto the green at the par-5 13th hole, setting up a two-putt birdie that gave him an eight shot lead in the Farmers Insurance Open.


At least he had plenty of time to savor this victory. The final five holes felt like they took forever.


Woods twirled his club on the tee and leaned on it in the fairway as the final round dragged on. He lost rhythm and appeared to lose interest, and it showed. A bogey from the bunker on the 14th. A tee shot that caromed off a eucalyptus tree on the 15th hole that led to double bogey. A tee shot he popped up on the 17th hole that left him 50 yards behind the other players and led to another bogey.


"It got a little ugly at the end," Woods said. "I started losing patience a little bit with the slow play."


No matter. It only affected the margin, not the outcome. Woods had to settle for an even-par 72 that gave him a four-shot win over defending champion Brandt Snedeker and Josh Teater, who each had a 69.


For a tour that has been criticized for slow play, this wasn't an ideal start to the network portion of its schedule. With Woods virtually a lock to win, CBS Sports wanted the final round to resume Monday later than normal so that it could be televised in late afternoon on the East Coast. Play was so slow that CBS went over its allotted time.


Woods, meanwhile, had the ideal start to his tour season.


Only a week earlier, he missed the cut in Abu Dhabi, in part because of a two-shot penalty assessed after his second round for taking an illegal drop. Woods had never missed the cut on the European Tour, and he had never started his season with the weekend off.


He might have been the only one who didn't panic.


Woods seized control with a 65 on the North Course at Torrey Pines, the spent the rest of the week pulling away from the field until no one could catch him.


"I don't know if anybody would have beaten him this week," said Nick Watney, who got within five shots of Woods when the tournament was still undecided until making three bogeys on his next five holes. "He's definitely on his game."


It's still too early to figure out the state of his game, especially in relation to Rory McIlroy, who also missed the cut in Abu Dhabi.


Torrey Pines is a public course that Woods treats like his private domain. He won the tournament for the seventh time, one short of the PGA Tour record for most wins in a single event. Sam Snead won the Greater Greensboro Open eight times. Woods won for the eighth time at Torrey Pines, including the 2008 U.S. Open, and that's a PGA Tour record that Woods previously shared with ... himself. He also has won seven times at Firestone and Bay Hill.


"I think he wanted to send a message," said Hunter Mahan, who shares a swing coach with Woods. "I think deep down he did. You play some games to try to motivate yourself. There's been so much talk about Rory. Rory is now with Nike. That would be my guess."


And it was his 75th win on the PGA Tour, seven short of the record held by Snead. Woods has won 23 of those tournaments by at least four shots.


"I'm excited the way I played all week," Woods said. "I hit the ball well — pretty much did everything well and built myself a nice little cushion. I had some mistakes at the end, but all my good play before that allowed me to afford those mistakes."


Woods mostly had reason to be excited about his short game.


In the third round Sunday, he was furious with himself for going long on the par-3 eighth green, without much green between his ball and the hole. Woods hit a chip solidly, with just enough loft, to leave himself a tap-in par. In the conclusion of the final round Monday, he pulled his tee shot into a bad spot in the bunker on the par-3 11th. The lie was good, but he had to aim well left, meaning his legs were spread wide on the slope of the sand.


He blasted it out with his 60-degree wedge to a top shelf, and then watched it feed down a slope to the right. It lost pace at the end or it might have gone in.


It looked good for television. It was a difficult shot, but not impossible.


But Woods believes those are the shots he wasn't converting a year ago. And that's one reason his outlook was so bright on the rest of the year, even after having to cope with so much fog along the Pacific bluffs.


He played the par 5s in 12 under for the lead — that alone would have been enough to win — and attributed that to his short game.


"My short game was back to how I know it can be," Woods said. "My shots that I hit, especially out of these nasty little lies, I hit some really good ones this week. And that allowed me to save some pars, make some birdies, and move my way up the board. And basically, that's what I did."


Woods figures his swing change under Sean Foley took root at some point last year, but that he had devoted so much time to the swing that he neglected his wedges. Now that he is practicing more on his short game, he expects better results — turning a 74 into a 70, and not losing leads at the majors, like he did twice last year.


Still, the season is young.


Any measure of Woods likely will have to wait until the road to the Masters gets going during the Florida Swing. Woods headed home to Florida on Monday night and is not expected to return until the Match Play Championship in Arizona a month from now. McIlroy also isn't expected to play until then, and match play being such a fickle format, the better gauge could come in the Honda Classic and at Doral.


Woods, however, likes where he is headed.


Torrey Pines is a good omen for the rest of his year. Whenever he starts a PGA Tour season with a win at Torrey, he tends to have big years — eight wins and two majors in 2006, seven wins and a major in 2007, four wins in only six starts in 2008.


Where will this lead?


"Does it feel good? Yes. Does it give me confidence? Absolutely," Woods said. "But as far as the other stuff, as I said, I'm excited about this year. I'm excited about what I'm doing with Sean and some of the things that I've built. This is a nice way to start the year."

Rescuer Appears for New York Downtown Hospital





Manhattan’s only remaining hospital south of 14th Street, New York Downtown, has found a white knight willing to take over its debt and return it to good health, hospital officials said Monday.




NewYork-Presbyterian Hospital, one of New York City’s largest academic medical centers, has proposed to take over New York Downtown in a “certificate of need” filed with the State Health Department. The three-page proposal argues that though New York Downtown is projected to have a significant operating loss in 2013, it is vital to Lower Manhattan, including Wall Street, Chinatown and the Lower East Side, especially since the closing of St. Vincent’s Hospital after it declared bankruptcy in 2010.


The rescue proposal, which would need the Health Department’s approval, comes at a precarious time for hospitals in the city. Long Island College Hospital, just across the river in Cobble Hill, Brooklyn, has been threatened with closing after a failed merger with SUNY Downstate Medical Center, and several other Brooklyn hospitals are considering mergers to stem losses.


New York Downtown has been affiliated with the NewYork-Presbyterian health care system while maintaining separate operations.


“We are looking forward to having them become a sixth campus so the people in that community can continue to have a community hospital that continues to serve them,” Myrna Manners, a spokeswoman for NewYork-Presbyterian, said.


Fred Winters, a spokesman for New York Downtown, declined to comment.


Presbyterian’s proposal emphasized that it would acquire New York Downtown’s debt at no cost to the state, a critical point at a time when the state has shown little interest in bailing out failing hospitals.


The proposal said that if New York Downtown were to close, it would leave more than 300,000 residents of Lower Manhattan, including the financial district, Greenwich Village, SoHo, the Lower East Side and Chinatown, without a community hospital. In addition, it said, 750,000 people work and visit in the area every day, a number that is expected to grow with the construction of 1 World Trade Center and related buildings.


The proposal argues that New York Downtown is essential partly because of its long history of responding to disasters in the city. One of its predecessors was founded as a direct result of the 1920 terrorist bombing outside the J. P. Morgan Building, and the hospital has responded to the 1975 bombing of Fraunces Tavern, the 1993 and 2001 attacks on the World Trade Center, and, this month, the crash of a commuter ferry from New Jersey.


Like other fragile hospitals in the city, New York Downtown has shrunk, going to 180 beds, down from the 254 beds it was certified for in 2006, partly because the more affluent residents of Lower Manhattan often go to bigger hospitals for elective care.


The proposal says that half of the emergency department patients at New York Downtown either are on Medicaid, the program for the poor, or are uninsured.


NewYork-Presbyterian would absorb the cost of the hospital’s maternity and neonatal intensive care units, which have been expanding because of demand, but have been operating at a deficit of more than $1 million a year, the proposal said.

DealBook Column: Mary Jo White, Nominee for S.E.C.'s 'New Sherrif,' Has Worn Banks' Hat

“You don’t want to mess with Mary Jo.”

That’s what President Obama said about his pick to run the Securities and Exchange Commission, Mary Jo White. The nomination of Ms. White, a former prosecutor who took on the terrorists behind the bombing of the World Trade Center in 1993 and the Mafia boss John Gotti, was meant to signal that the S.E.C. would be getting tough on Wall Street. CBS called her “Wall Street’s new sheriff.” The Wall Street Journal said she would be “putting a tougher face on an agency still tainted by embarrassing enforcement missteps in the run-up to the financial crisis.” The New York Times said her appointment represented a “renewed resolve to hold Wall Street accountable.”

Hold on.

While Ms. White is a decorated prosecutor, she has spent the last decade vigorously defending — and billing by the hour — Wall Street’s biggest banks, as a rainmaking partner at the white-shoe law firm Debevoise & Plimpton. The average partner at the firm was paid $2.1 million a year, according to American Lawyer; but she was no average partner, very likely being paid at least double that. Her husband, John W. White, is a corporate partner at Cravath, Swaine & Moore. He counts JPMorgan Chase, Credit Suisse and UBS as clients. The average partner at Cravath makes $3.1 million. He, too, was a former official at the S.E.C. — he left Cravath to run the corporate division of the S.E.C. starting in 2006 just in time for the run-up to the financial crisis. He left in November 2008, a month after the bank bailouts, to return to Cravath.

It seems Mr. and Ms. White have made a fine art of the revolving door between government and private practice.

So how conflicted is Ms. White? Let’s count the ways.

They are well documented: she was JPMorgan Chase’s go-to lawyer for many of the cases brought against it relating to the financial crisis. She was arm-in-arm with Kenneth D. Lewis, Bank of America’s former chief executive, keeping him out of trouble when the New York attorney general accused Mr. Lewis of defrauding investors by not disclosing the losses at Merrill Lynch before completing Bank of America’s acquisition of the firm. (And empirically, Mr. Lewis did keep crucial information about the deal from investors.)

This is what she had to say about Mr. Lewis, in a court filing submitted on his behalf: “Some have looked to assign blame for every aspect of the financial crisis, even where there is no evidence of misconduct. This case is a product of that dynamic and does not withstand either legal or factual scrutiny.” It was a refrain she often made about her clients related to the financial crisis.

And then there was Senator Bill Frist, the Republican from Tennessee, whom she successfully represented when the S.E.C. and the Justice Department started an investigation into whether he was involved in insider trading in shares of HCA, the hospital chain. She persuaded them to shut down the investigation.

She also worked with Siemens, the German industrial giant, when it pleaded guilty to charges of bribery, paying a record $1.6 billion penalty.

And then, of course, there was John Mack. She worked for the board of Morgan Stanley during a now well-publicized 2005 investigation into insider trading that ended soon after she made a phone call to the S.E.C. Using her connections at the top of the agency, she dialed up Linda Thomsen, then the commission’s head of enforcement, to find out whether Mr. Mack, who was being considered for Morgan Stanley’s chief executive position, was being implicated. He ultimately wasn’t. As the Huffington Post pointed out in a recent article about Ms. White, Robert Hanson, an S.E.C. supervisor, later testified, “It is a little out of the ordinary for Mary Jo White to contact Linda Thomsen directly, but that White is very prestigious and it isn’t uncommon for someone prominent to have someone intervene on their behalf.”

All of Ms. White’s previous engagements create not only an “optics” problem, but a practical, on-the-job problem. She will most likely need to recuse herself from just about anything related to her previous work.

“I will not for a period of two years from the date of my appointment participate in any particular matter involving specific parties that is directly and substantially related to my former employer or former clients, including regulations and contracts,” is the language in an ethics pledge that she will have to agree to follow.

Some appointees, including Mary L. Schapiro, the former chairwoman of the S.E.C., recused themselves from any involvement in work that was related to a previous employer even after the two-year moratorium. Gary Gensler, the chairman of the Commodity Futures Trading Commission, recused himself from the investigation into MF Global because of his previous employment at Goldman Sachs, where Jon Corzine was the firm’s head, even though it had been years since the two had worked together.

And then there is the issue of Mr. White’s husband, who will have a continuing role at Cravath, one of the most pre-eminent firms in the country, whose clients include some of the nation’s largest corporations.

“This president has adopted the toughest ethics rules of any administration in history,” said Amy Brundage, a White House spokeswoman, “and this nominee is no exception. As S.E.C. chair, Mary Jo White will be in complete compliance with all ethics rules.”

None of these conflicts gets at another potential problem for Ms. White. The job of chairwoman of S.E.C. isn’t simply about enforcement; she has a deputy for that. The biggest challenge anyone who takes the job will have to confront over the next several years will be executing and enforcing provisions of Dodd-Frank and working to regulate electronic trading — something that even the most sophisticated financial professionals, let alone a lawyer, often have a tough time understanding. She has zero experience in this area.

Of course, there can always be a value to inviting a onetime rival onto the team.

“I believe she is one of those people who will understand that her public role will be very, very different than her role as a defense lawyer,” Dennis M. Kelleher of Better Markets, a watchdog group, told me. “I don’t think she’s going to be like so many others who don’t get that they have a very different role when they hold high public office.

“No question, she’s said some things that are controversial and questionable,” Mr. Kelleher said. “Moreover, I hope and expect that she will be asked publicly about them in the confirmation process and that she will have convincing answers.”

Of course, if she is confirmed, we must all hope that she can put her previous client relationships behind her and work for her new client — us.

Stanley Karnow, Historian and Journalist, Is Dead at 87





Stanley Karnow, a Pulitzer Prize-winning historian and journalist who produced acclaimed books and television documentaries about Vietnam and the Philippines in the throes of war and upheaval, died on Sunday at his home in Potomac, Md. He was 87.




The cause was congestive heart failure, said Mr. Karnow’s son, Michael.


For more than three decades Mr. Karnow was a correspondent in Southeast Asia, working for Time, Life, The Saturday Evening Post, The Washington Post, NBC News, The New Republic, King Features Syndicate and the Public Broadcasting Service. But he was best known for his books and documentaries.


He was in Vietnam in 1959, when the first American advisers were killed, and lingered long after the guns fell silent, talking to fighters, villagers, refugees, North and South Vietnamese political and military leaders, the French and the Americans, researching a people and a war that had been little understood.


The result was the 750-page book “Vietnam: A History,” published in 1983, and its companion, a 13-hour PBS documentary, “Vietnam: A Television History.” Unlike many books and films on Vietnam in the 1960s and ’70s and the nightly newscasts that focused primarily on America’s role and its consequences at home and abroad, Mr. Karnow addressed all sides of the conflict and traced Vietnam’s culture and history.


“Vietnam: A History” was widely praised and a best seller. The documentary, with Mr. Karnow as chief correspondent, was at the time the most successful ever produced by public television, viewed by an average of nearly 10 million people a night through 13 episodes. It won six Emmy Awards, as well as Peabody, Polk and duPont-Columbia awards.


Six years later, Mr. Karnow delivered his second comprehensive book and television examination of a Southeast Asian nation. The book, “In Our Image: America’s Empire in the Philippines” (1989), was a panorama of centuries of Filipino life under Spanish and American colonial rule, followed by independence under sometimes corrupt American-backed leaders. It won the 1990 Pulitzer Prize for history.


Narrated by Mr. Karnow, the three-part PBS documentary “The U.S. and the Philippines: In Our Image” traced America’s paternalistic colonial rule in the Philippines, the shared suffering of Filipinos and Americans under a cruel Japanese occupation in World War II, and Manila’s postwar independence under regimes nominally democratic but repressive, corrupt or indifferent to the miseries of its people.


Mr. Karnow also wrote “Mao and China: From Revolution to Revolution” (1972) and was a co-author of or contributor to books based on his years in Asia, including “Asian-Americans in Transition” (1992), “Passage to Vietnam” (1994), “Mekong” (1995) and “Historical Atlas of the Vietnam War” (1995).


Early in his career he lived in Paris for a decade, and in 1997 he published a memoir, “Paris in the Fifties.” A nostalgic reporter’s notebook of life among the cafe philosophers, berated musicians and pseudo-revolutionary artistes, it danced with digressions about taxes, restaurants, the guillotine, Hemingway, Charles de Gaulle and the Devil’s Island penal colony.


In its range, learning and appetite for fun, Bernard Kalb, the former CBS reporter and Mr. Karnow’s friend since Vietnam, told The Associated Press in 2009, the memoir was vintage Karnow. “Stanley has a great line about how being a journalist is like being an adolescent all your life,” he said.


Stanley Karnow was born in Brooklyn on Feb. 4, 1925, the son of Harry and Henriette Koeppel Karnow. He grew up in a city with more than a dozen daily newspapers and decided early that he wanted to become a reporter. He served in the Army Air Forces in World War II. After graduating from Harvard with a bachelor’s degree in 1947, he sailed for France, intending to spend the summer. He stayed for a decade.

Providence theater experiments with ‘tweet seats’






PROVIDENCE, R.I. (AP) — Sarah Bertness slipped into her seat at a recent staging of the musical “Million Dollar Quartet” and, when the lights dimmed, started doing something that’s long been taboo inside theaters: typing away at her iPhone.


The 26-year-old freelance writer from Providence wasn’t being rude. She had a spot in the “tweet seat” section at the Providence Performing Arts Center.






The downtown theater is now setting aside a small number of seats — in the back — for those who promise to live-tweet from the performance using a special hash tag. They might offer impressions of the set, music or costumes, lines of dialogue that resonate with them or anything else that strikes them, really.


At “Million Dollar Quartet,” based on the true story of a 1956 recording session that united music greats Johnny Cash, Elvis Presley, Jerry Lee Lewis and Carl Perkins, PPAC for the first time had cast members tweeting from backstage, too.


A growing number of theaters, including some on Broadway, have been experimenting in recent years with tweet seats and other real-time uses of social media as they try to figure out the relationship between the stage and the smartphone.


Some insist the theater should remain a sacred, technology-free place and that allowing the use of phones during a show — even discreetly — only serves as a potential distraction for other patrons. But others say theaters can’t afford not to engage the digital generation, and that the way performances were once enjoyed, in a vacuum, doesn’t hold up anymore.


“I think that it’s important that PPAC and cultural institutions in general kind of jump on the social media bandwagon and learn to engage a broader audience,” said Bertness, who runs the blog The Rhode Islander and is such a big Johnny Cash fan that she showed up to the performance wearing all black. “I think it’s such a valuable tool.”


Scott Moreau, an understudy for Johnny Cash, hadn’t ever tweeted from backstage during a performance. He tried to provide a glimpse of what life’s like on the tour, which he likened to the special features on a DVD. He said he enjoyed getting instant feedback from the tweeters — feedback he shared with other cast members.


“It makes it feel a lot more personal,” Moreau said.


A picture of Moreau that was tweeted out from backstage — he was tweeting in it himself — prompted someone in the tweet seats to declare that’s what the Man in Black would have looked like, with an iPhone.


Other theaters are also trying different digital ways to engage with patrons. In Boston, the Huntington Theater plans to introduce a “Twittermission” where an artist affiliated with the production, or someone from the theater’s staff, answers questions about the show on Twitter during intermissions. The tweets will also be projected on screens in the theater lobby, according to spokeswoman Rebecca Curtiss.


The theater won’t be introducing tweet seats, though.


“We feel strongly that the experience that an audience member has in our theater should be limited to what they are seeing on the stage,” Curtiss said. “When the lights go down and the show begins, we want the art on stage to speak for itself.”


PPAC isn’t sure yet whether any social media buzz generated by those in the tweet seats will have a measurable effect at the box office. But spokeswoman P.J. Prokop said the theater intends to keep the program through the end of the year, and then evaluate it. Those who sit in the tweet seats get their tickets for free.


Kirsten DiChiappari, who has tweeted three shows there to her nearly 1,400 followers, grew up in New Jersey going to Broadway musicals, plays and the opera. The 41-year-old social media consultant from Bristol sees her live-tweeting as a way to lure people from their living rooms, where many are glued to “horrible reality television.”


“It’s kind of a way to tease people back to support the live arts, the real arts, the original arts,” she said. “I feel like once they go, they’ll go again.”
